For the use of this website and the business relationships between <Geistreich> and its customers, the following General Terms and Conditions (GTC) apply in the currently available and valid version when the website is accessed or when goods are ordered. The offer on this website is aimed at customers residing in Switzerland, Liechtenstein, Germany, Austria, France, Italy and the Netherlands.

Any natural or legal person who maintains a business relationship with <Geitreich> is referred to as a customer. The terms and conditions, the delivery and payment conditions as well as the data protection regulations can be adjusted from time to time. <Spiritual> asks you to read these provisions carefully each time you visit the website and each time you order goods.

These terms and conditions apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation of <Geistreich> in order to be valid. When using this website or when ordering goods, the customer confirms that they fully accept these General Terms and Conditions, including the terms of delivery and payment.

Should individual provisions of these General Terms and Conditions prove to be ineffective or unenforceable or become ineffective or unenforceable, the validity of the remaining provisions shall remain unaffected.

All offers on this website are subject to change and are not to be understood as a binding offer.

3.Prices

The prices quoted by <Geistreich> are strictly net in Swiss francs (CHF).

Unless otherwise provided, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process.

 

We reserve the right to make technical changes, errors and misprints. In particular, <Geistreich> can make price changes at any time and without prior notice. The sales prices do not include any consulting and support services.

 

4. Conclusion of contract

The offers on this website represent a non-binding invitation to the customer to order products and/or services from <Geistreich>. With the order via this website including the acceptance of these terms and conditions, the customer submits a legally binding offer to conclude a contract. <Geistreich> then sends an automatic "order confirmation" by email, which confirms that <Geistreich> has received the customer's offer. Orders placed are binding for the customer. Unless otherwise noted, there is no right of return or withdrawal.

The contract is concluded as soon as <Geistreich> sends a declaration of acceptance by email, in which the dispatch of the ordered products or services is confirmed.

Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided the goods are available. If, after conclusion of the contract, the ordered goods cannot be delivered or cannot be delivered in full, <Geistreich> is entitled to withdraw from the entire contract or part of it. If the customer's payment has already been received by <Geistreich>, the payment will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. <Geistreich> is not obliged to make a replacement delivery in the event of a contract termination.

 

5. Payment options and retention of title

The payment options specified in the ordering process are available to the customer.

<Geistreich> reserves the right to exclude customers from individual payment options without giving reasons or to insist on prepayment. The sum specified in the confirmation email must be paid by the customer within 10 days. If the customer is in default of payment, <Geistreich> can charge default interest of 5% per year and a reminder fee of a maximum of CHF 20 from the 3rd reminder. The products delivered to the customer remain the property of <Geistreich> until full payment has been made

 

 

6. Delivery, obligation to check, notification of defects and return

Deliveries are sent by post or courier to the address indicated by the customer in the order. Invoicing takes place via email. With the shipment, benefit and risk are transferred to the customer, insofar as this is legally permissible. If the delivery cannot be delivered or if the customer refuses to accept the delivery, <GEISTREICH> can dissolve the contract after informing the customer of a complaint by email and setting a reasonable period of time and charging the costs for the activities. The customer is obliged to check the delivered goods immediately after receipt of the delivery and to report any defects for which <Geistreich> provides a guarantee immediately in writing by email to the address in (>Imprint). The goods offered by Geistreich are "art", which is why Geistreich cannot accept returned goods. Returns to <Geistreich> are made at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address given by <Geistreich> in the (>imprint).

 

7. Right of withdrawal, not required by law in Switzerland)

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

The right of withdrawal does not apply to distance contracts,

- For the delivery of goods or data that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

- for the delivery of digital data or computer software in sealed packaging if the seal has been broken after delivery;

- for the delivery of digital data or computer software if the delivery has been made as a download;

- for the delivery of unlock codes for data, software or digital services if the unlock code's privacy shield has been removed after delivery or if the unlock code has been transmitted by download or email.

 

In order to exercise your right of withdrawal, you must inform us (Geistreich by Patrizia Nicoisa, Güterstrasse 271, 4053 Basel, e-mail: info@geistreich.ch) by means of a clear statement (e.g. a letter sent by post, fax or e-mail). inform you of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory. You can also electronically fill out and submit the model cancellation form or any other clear statement on our website. If you make use of this option, we will immediately (e.g. by e-mail) send you confirmation of receipt of such a revocation.

 

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

 

Consequences of revocation

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

 

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

 

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

 

8.Warranty

<Spiritual> endeavors to deliver goods of impeccable quality. In the case of defects reported in good time, <Geistreich> assumes the warranty for freedom from defects and functionality of the item purchased by the customer during the statutory warranty period of usually two years from the date of delivery. It is at the discretion of <Geistreich> to provide the warranty through free repair, equivalent replacement or refund of the purchase price. Further claims are excluded.

Normal wear and tear and the consequences of improper handling or damage by the customer or third parties, as well as defects attributable to external circumstances, are not covered by the warranty. Likewise, the warranty for consumable and wear parts (e.g. batteries, rechargeable batteries, etc.) is waived.

It is not possible for <Geistreich> to provide any assurances or guarantees that the data is up-to-date, complete or correct, or that the website, its functions, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties that are not owned by <Geistreich>.

 

9.Liability

<Geistreich> excludes all liability, regardless of its legal basis, as well as claims for damages against <Geistreich> and any auxiliary persons and vicarious agents. In particular, <Geistreich> is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss of the customer. A further mandatory statutory liability remains reserved, for example for gross negligence or illegal intent.

<Geistreich> only uses hyperlinks to simplify customer access to other websites. <Geistreich> can neither know the content of these websites in detail, nor assume liability or any other responsibility for the content of these websites.

 

10.Other Provisions

<Geistreich> expressly reserves the right to change these General Terms and Conditions at any time and to put them into effect without prior notice.

In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law norms. The UN Sales Convention (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is Basel, unless the law provides for mandatory places of jurisdiction.

 

11. Workshops

Registration for the workshop is binding and cannot be refunded due to the preparations. The workshop place can be passed on to another person, please notify us at least 7 days in advance. Any liability in the event of damage is rejected.
